These additional disclosures are outlined to cover specific notices related to your rights in certain U.S. states. Any capitalized terms not defined in this document have the same meaning used in the Website Privacy Policy and the VideoAmp Offerings Privacy Policy.
For California Residents: Notice at Collection
We collect personal information in two contexts:
- From end users of our Customers or other websites, apps, and other digital properties that use our Company Offerings; and
- In connection with our Sites, which are directed to individuals over the age of 18 who are acting in a professional capacity and represent prospective and current commercial customers (“Visitors”).

We collect precise location and information about race and ethnicity, which is considered sensitive information.
We use the personal information listed above to provide the Company Offerings, as described in more detail here.
We determine the retention period for personal information based on: 1) the terms of any applicable license agreements; 2) the terms of our agreements with our Customers; and 3) whether the personal information is still required to provide the Company Offerings, to maintain business continuity, or comply with our legal obligations. We may retain personal information that has been archived for a longer window.

U.S. Privacy Rights
The following U.S. states have privacy laws that provide their residents with additional rights: California, Colorado, Delaware, Iowa, Virgina, Connecticut, Tennessee, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, and Utah. This notice contains additional information for residents of those states.
If you live in one of the states listed above, subject to certain exceptions, you have additional rights regarding our processing of your personal information. However, these rights are not absolute and may only apply in certain circumstances. For example, when we process information as a service provider, you need to contact whichever company that is the “business” or “controller” for your information to exercise your rights with respect to that information.
- Right to Know / Access. You may have the right to request the categories of personal information we collect, the categories of sources from which we collect it, the purposes for which we process it, the categories of third parties (or in certain jurisdictions, a list of the third parties) to whom we disclose it, and the specific pieces of personal Information that we have collected about you.
- Residents of Oregon, Minnesota, and Delaware also have the right to request information about the specific third parties we have disclosed personal information to.
- Right to Correct. You may have the right to request that we correct inaccurate personal information maintained about you.
- Right to Delete. You may have the right to request that we delete the personal information that we have collected about you.
- Right to Opt-Out of Sale / Sharing / Targeted Advertising. You may have the right to opt out of the “sale”, “sharing” or processing of your personal information for targeted advertising.
- Right to Limit Use or Disclosure of Sensitive Personal Information. You may have the right to request that we limit the use and disclosure of the sensitive personal information maintained about you.
- Right to Appeal. You may have the right to appeal if we decided not to take action on your request.

- To opt-out of the sale/sharing of personal information through cookies, visit the “Cookie Settings” icon available on the Website. Some browsers offer you the ability to opt out of cookie-based and other online tracking, which may be considered a “sale” or “sharing” of your personal information. At this time, we only respond to browser-based opt-out signals sent through the Global Privacy Control: https://globalprivacycontrol.org/. When you opt-out of sale or share via the GPC, we accept that signal and honor it. As noted in our Website Privacy Policy, we do not respond to “do not track” or other browser-based signals.
We will not discriminate against you for exercising any of the rights described above.
Identity Verification
For certain rights, we may need to collect information from you to verify your identity before providing a substantive response to the request.
Authorized Agents
Depending on your location, you may designate, in writing or through a power of attorney document, an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. Depending on your location, you may have the right to appeal our decision regarding a request related to these rights by contacting us using the information provided above.
VideoAmp will maintain records of consumer requests made pursuant to applicable privacy laws and how we responded to those requests in accordance with such laws.
